BOARD OF WATER COMMISSIONERS

Meeting on November 2, 2012

Present:  Chairman Donald Bates, Vice Chairman Allin Thompson, Clerk Danette Gonsalves, Superintendent Craig Wiegand, Secretary Alexandra Bilek, Senior Billing Administrator Wellesley Marsh, Comptroller Sandra Cummings, Angelo LaMantia, John Pina

Chairman Donald Bates called the meeting to order at 8:20 a.m.

The minutes for the previous meeting held on October 16, 2012 were approved with a motion by Clerk Gonsalves and seconded by Vice Chairman Thompson; 3-0-0.

Mr. John Pina was in attendance petitioning the Board to install a water main on Oak St by his property.  The Board took it under advisement, and will vote on it at the next meeting.

The Board reviewed the abatement request from Lawrence Kolbin of 22 Spinnaker Ln in regard to water usage.  Upon review and discussion Clerk Gonsalves moved to deny the abatement request with a second by Vice Chairman Thompson; 3-0-0.

The Board reviewed the abatement request from Edward Daly of 231 Route 28 in regard to a late fee.  Upon review and discussion Clerk Gonsalves moved to deny the abatement request with a second by Vice Chairman Thompson; 3-0-0.

The Board reviewed the abatement request from Stacia Kostecki of 141 Division St in regard to water usage.  Upon review and discussion Clerk Gonsalves moved to deny the abatement request with a second by Vice Chairman Thompson; 3-0-0.

Superintendent Wiegand said he is waiting for a letter from Town Counsel in regard to the AT&T cell tower proposal.  He said he applied for State Revolving Funds for the North Harwich Treatment Plant, but is not hopeful the Department will be awarded it again.

Comptroller Sandra Cummings presented the Board with a draft of the FY14 Budget.  Chairman Bates moved to approve the FY14 Budget with a second by Clerk Gonsalves; 3-0-0.

Ms. Cummings presented the Board with the FY13 Lien List.  Clerk Gonsalves moved to approve the Lien List not to exceed the amount of $18,712.79 with a second by Vice Chairman Thompson; 3-0-0.

Mr. Wiegand informed the Board that National Grid and N-Star are delinquent on their bills.  He said  letters dated October 22, 2012, were sent stating that as of the date of the letters the Department will cease and desist mark out services until their bills are paid in full.  Vice Chairman Thompson moved as of October 22, 2012, to cease and desist mark out services to National Grid and N-Star until their balances are paid with a second by Clerk Gonsalves; 3-0-0.

Mr. Wiegand informed the Board that a company by the name of HomeServe USA, has been contacting our customers offering the same service as our Service Tight Program.  He said as the Department is the only entity that can install/repair water services, he sent a letter to this company requesting that they cease contacting our customers.  Mr. Wiegand said he received a letter from their attorney stating the Harwich Water Department has established a monopoly in town.  He said the letter has been sent to Town Counsel for review.

The Board will meet again on Tuesday, November 20, 2012.

The meeting was adjourned at 9:35 a.m. with a motion by Chairman Bates and a second by Vice Chairman Thompson; 3-0-0.
